These terms are an agreement between you and ModeBit LLC, doing business as DrawMode ("DrawMode", "we", "us"), a [state] limited liability company. They cover drawmode.ai, the web app at app.drawmode.ai, the DrawMode desktop app, Showcase sites at showcase.drawmode.ai and the MCP connection for coding agents (together, "DrawMode"). By creating an account, installing the desktop app or using DrawMode, you agree to them. Our Privacy Policy and Refund Policy are part of these terms.
1. Who can use DrawMode
You must be at least 16 years old. If you use DrawMode for a company or other organization, you confirm that you can agree to these terms on its behalf, and "you" includes it.
2. Your account
- Give accurate information and keep your sign-in, your connection keys and your desktop key secret. You are responsible for what happens under your account.
- An account is for one person. A Company subscription gives each person their own seat; seats are not shared logins.
- Tell us at info@drawmode.ai if you think someone else has used your account.
3. Plans, the trial and payment
- Community is free. Professional and Company are paid subscriptions at the prices on our Pricing page when you subscribe. What each plan includes, and its limits, are on that page.
- A new web account starts with a free Professional trial (currently 14 days) and needs no card. When it ends, the account moves to Community unless you subscribe.
- Subscriptions are billed in advance, in US dollars, monthly or yearly, and renew automatically until you cancel. Payments are processed by Stripe; we never see or store your full card number. Prices do not include taxes, which we add where the law requires.
- A Company is billed to its admin, per seat, every month. Adding or removing a seat is charged or credited pro rata on the next invoice. Removing someone's seat ends their Professional plan.
- Changing plan is billed as the plan dialog shows before you confirm it. Moving to a different billing period settles the current one at once: unused time is credited to your account, not refunded.
- If a payment fails, Stripe retries it and emails you. If the last retry fails, the subscription ends.
- We may change prices. A new price applies from your next renewal after we tell you about it, and you can cancel before then.
4. Cancelling and refunds
You can cancel at any time from Manage subscription in the plan dialog. Your plan stays active until the end of the period you have paid for and does not renew. Refunds are covered by our Refund Policy.
5. When a plan ends
Your work is kept when a trial or subscription ends. Anything beyond the Community plan's limits stays viewable but becomes read-only until you subscribe again or bring it within the limits. Paid features, such as the MCP connection and collaboration on the web, stop.
6. Your content
- You own the diagrams, documents, images and other material you create in or bring to DrawMode ("your content"). We claim no ownership of it.
- You give us permission to host, store, copy, process, display and send your content only as needed to run DrawMode for you: for example, to show it to the people you share it with, to publish a Showcase site you choose to publish, and to send it to an AI provider when you use an AI feature. This permission ends when you delete the content, except for copies kept briefly in backups.
- We do not sell your content and do not use it to train AI models.
- You confirm you have the rights to the content you put into DrawMode.
7. Sharing, collaboration and Showcase sites
Content you share with other people, groups or a Company is visible to them, and they may be able to edit it. A Showcase site you publish is public to anyone with its address, unless you set a password. You are responsible for what you share and publish. We may take down a Showcase site that breaks these terms.
8. AI features and coding agents
- AI features send the material needed for your request (for example the diagram you are working on, your message, an image or a document) to an AI provider to produce an answer. AI output can be wrong; check it before you rely on it. Our Privacy Policy names the providers.
- When you connect a coding agent through MCP, it acts as you within the project it is connected to. You are responsible for what it does. You can revoke its key at any time.
- AI use is subject to fair use. We may limit it when an account goes far beyond normal use.
9. The desktop app
You may install and use the desktop app on your own computers. It keeps your projects as files on your disk. It checks for updates, and if you connect it to a web account it checks your plan once a day. Where a part of DrawMode is released under an open-source licence, that licence governs your use of that part, and nothing in these terms limits it.
10. Acceptable use
Do not use DrawMode to:
- break the law, or infringe anyone's rights, including intellectual property and privacy;
- upload malware, or try to get into accounts, projects or systems that are not yours;
- overload, disrupt, scrape or probe the service, or get around its limits, plans or security;
- publish material that is unlawful, harassing, hateful or sexually explicit involving minors;
- resell or share access to the service, except as a Company plan allows.
11. Suspension and closing your account
You can stop using DrawMode at any time, and delete your account with Delete my account… in the app's account menu, or by writing to info@drawmode.ai. We may suspend or close an account that breaks these terms or does not pay, and will tell you why unless the law or safety prevents it. What happens to your data after an account is closed is in our Privacy Policy.
12. Changes to DrawMode and to these terms
DrawMode will change over time: we add, change and sometimes remove features. If we change these terms in a way that matters, we will tell you by email or in the app at least 14 days before the change applies. Using DrawMode after that means you accept the new terms; if you do not, you can cancel.
13. Disclaimers
DrawMode is provided "as is" and "as available". We work to keep it running and your data safe, but we do not promise it will be uninterrupted or error-free, or that it suits a particular purpose. Keep your own copies of work that matters to you; the desktop app and exports make that easy.
14. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about DrawMode is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
15. Indemnity
If someone brings a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.
16. Governing law
These terms are governed by the laws of [state], USA, without regard to its conflict-of-law rules. Disputes go to the courts of [county, state]. If you are a consumer in a country whose law gives you the right to use its courts or its law, these terms do not take that right away.
